1. Who we are
Kempian AI is an AI-driven workforce intelligence and management platform operated by Adept AI Inc. This Privacy Policy describes how we collect, use, share and protect information when you use our platform at app.kempian.ai, our marketing site at kempian.ai, and our TalentOps 360 managed recruiting services.
2. Information we collect
Account data (name, email, company, role, plan). Billing data (processed by our payment processor; we store subscription status, plan, and a record of your accepted Terms & Privacy version at checkout — we do not store full card numbers). Workforce data (requisitions, candidate profiles, matching insights, outreach records). Candidate data from public professional registries or uploaded by customers. Lead/demo and Request-for-Proposal submissions. Usage data via privacy-first analytics.
3. Consent at checkout
When you purchase a subscription or managed service, you must affirmatively accept these policies. We record your acceptance together with the exact policy versions then in effect and the time of acceptance, providing a demonstrable, auditable consent record (GDPR Art. 7(1)).
4. How we use information
To provide the platform and AI Confidence features; to deliver TalentOps 360 managed services through our recruiting team; to match candidates to requisitions using named, documented factor groups; to operate outreach on behalf of customers with human approval; to process payments and manage subscriptions; to respond to demo and proposal requests; and to improve reliability using anonymised usage data only.
5. AI and automated processing
Kempian uses supervised AI to generate candidate match insights. These are decision-support outputs subject to mandatory human review before any action, and therefore do not constitute solely-automated decisions under GDPR Art. 22. The AI evaluates named professional signals only (skills, certifications, experience, location, compliance status); it does not infer demographic or protected-class attributes. Your data is not used to train the shared AI model.
6. Managed services (TalentOps 360)
For TalentOps 360, our recruiting personnel (delivery managers, recruiters, credentialing and payroll specialists) access your workforce and candidate data solely to deliver the service to you, under confidentiality obligations and the same tenant-isolation controls. We do not share your data with other customers.
7. Healthcare, licensure and credentialing data
Where you use the services for healthcare staffing, we may process candidate health, licensure and credentialing information on your behalf, applying heightened safeguards. You are responsible for the lawful basis to share such data and for any HIPAA or equivalent obligations applicable to you.
8. How we share information — subprocessors
We share data only with vetted subprocessors who help us run the service, under contract and data-protection terms: cloud infrastructure (Amazon Web Services, US region), payment processing (Stripe), and transactional email/SMS providers for outreach and notifications. We do not sell personal data. A current subprocessor list is available on request.
9. Data storage and isolation
Kempian production data is stored and processed in the United States (us-east-1). Each customer's records sit in their own isolated data scope, and requests are scoped to the authenticated customer's workspace. Candidate records are shared between customers only where a candidate or customer has opted in to the shared talent pool or the public job marketplace. Files are stored under the same scoping.
10. Data retention
We retain account and subscription data for the life of your account and as required for legal, tax and compliance purposes, then delete or anonymise it. Candidate and workforce records are retained per the governance class applied at ingestion and your configuration. Consent and billing records are retained as required by law.
11. Your rights (GDPR / CCPA and similar)
Depending on your location, you may have the right to access, correct, delete, port, or restrict/object to processing of your personal data, and to withdraw consent. To exercise these rights, contact privacy@kempian.ai. Candidates may also exercise rights as described below.
12. Candidate opt-out
Candidates who receive outreach via Kempian may opt out at any time by replying STOP or using the unsubscribe link. Opt-out records are maintained and enforced before any subsequent outreach across all customers.
13. Security
We apply administrative, technical and organisational safeguards including encryption in transit, least-privilege access, audit logging of state changes, and tenant isolation. No method of transmission or storage is perfectly secure; we work to protect your data and to notify you of material incidents as required by law.
14. International transfers
We process data in the United States. Where we receive personal data from the EEA/UK, we rely on appropriate safeguards (such as Standard Contractual Clauses) for any transfer, available on request.
15. Analytics
Our marketing site uses privacy-first analytics that collect no cookies, no personal data, and no cross-site tracking.
16. Changes to this policy
We may update this Privacy Policy; material changes take effect on the date stated in the updated version, and your acceptance is recorded at your next checkout. The current version is shown at the top of this page.
